Terms and Conditions

These Terms of Service ("Terms") apply to the Visualize AI mobile application and related services (the "Application") provided by Pothos Digital ("we", "us", or "our"). By downloading, accessing, or using the Application, you agree to these Terms.

Visualize AI lets you upload or capture room photos, describe design changes, generate AI-edited images, save or share results, and manage subscriptions. You are responsible for your use of the Application and for making sure you have the rights and permissions needed for any content you upload.

Unauthorized copying, modification, distribution, reverse engineering, source-code extraction, translation, or creation of derivative versions of the Application is prohibited except to the extent permitted by applicable law. All trademarks, copyrights, database rights, and other intellectual property rights in the Application remain owned by us or our licensors.

It is your responsibility to maintain the security of your device, account, and access to the Application. Jailbreaking, rooting, or otherwise modifying your device may compromise security and may cause the Application to malfunction.

User Content and AI Outputs

You retain any rights you have in photos, prompts, and other content you upload or submit to the Application ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to process, transmit, and display User Content only as needed to provide, maintain, protect, and improve the Application, including by sending photos and prompts to our AI and infrastructure providers. We do not retain your original uploaded photos in your account after processing.

You represent that you own or have permission to use the User Content you submit, and that your User Content and use of the Application will not violate anyone else's rights or applicable law.

AI-generated outputs may be inaccurate, unexpected, similar to outputs generated for other users, or unsuitable for your intended purpose. We do not guarantee that any generated output is unique, error-free, non-infringing, or fit for professional, design, construction, purchasing, or safety decisions. You are responsible for reviewing outputs before relying on or sharing them.

Acceptable Use

You agree not to misuse the Application or help anyone else do so. You may not:

• Upload content you do not have the right to use
• Use the Application for illegal, harmful, abusive, deceptive, or infringing purposes
• Attempt to generate or distribute unlawful, hateful, sexual, violent, exploitative, or otherwise harmful content
• Bypass subscriptions, usage limits, security measures, or access controls
• Scrape, overload, reverse engineer, or interfere with the Application or its providers
• Use automated systems to access the Application without our permission

We may suspend or terminate access, remove content, or refuse to process requests if we believe these Terms have been violated or if continued use could harm users, us, third parties, or the Application.

Subscriptions and Purchases

Some features require a paid subscription or other in-app purchase. Prices, billing periods, included generation credits, and subscription details are shown before purchase. Purchases are processed by the applicable app store and/or RevenueCat.

Subscriptions renew automatically unless cancelled before the end of the current billing period through your app store account settings. Deleting the Application or deleting your Visualize AI account does not automatically cancel an active app store subscription.

Refunds, cancellations, billing disputes, and payment method issues are handled according to the rules of the app store or payment provider that processed your purchase. We may change, add, or remove paid features, plans, prices, usage limits, or free trials, but any material charges will be presented before purchase where required.

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

Service Limitations

Some functions of the Application require an active internet connection. We are not responsible if the Application does not function at full capacity because you lack internet access, have exhausted your data allowance, or experience network or provider outages.

If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the Application, or other third-party charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the Application, we assume that you have obtained permission from the bill payer.

It is also your responsibility to ensure that your device remains charged and compatible. If your device runs out of battery or cannot run the Application, we are not responsible for your inability to access the service.

We provide the Application and AI-generated outputs on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the Application.

Application Updates and Termination

We may update the Application from time to time. The Application is currently available as per the requirements for the operating system (and for any additional systems we decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to continue using the Application. We do not guarantee that we will always update the Application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the Application when offered to you.

We may also cease providing the Application or terminate or suspend your access at any time, including if you violate these Terms. Unless we inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these Terms will end; (b) you must cease using the Application, and (if necessary) delete it from your device.

Changes to These Terms and Conditions

We may periodically update these Terms. We will notify you of changes by posting the updated Terms on this page. Continued use of the Application after changes become effective means you accept the updated Terms.
